Being LGBTQ+ is considered ideologically incompatible with the regime and treated as a form of "capitalist degeneracy." Defectors have reported individuals being sent to political prison camps (kwanliso) for same-sex relations. There is no safe way to be openly LGBTQ+ in North Korea.

Legal Framework

  • The Criminal Law of the DPRK does not contain an explicit article criminalizing same-sex acts by name
  • However, ILGA World classifies North Korea as "presumed illegal" โ€” state repression of homosexuality occurs through broadly applied provisions against "anti-socialist behaviour," "debauchery," and ideological deviation
  • The regime views homosexuality as a Western/bourgeois phenomenon incompatible with Juche (self-reliance) ideology
  • Defector testimonies documented by ILGA, HRW, and the UN Commission of Inquiry describe individuals imprisoned in political prison camps for same-sex relations
  • Freedom of expression, assembly, and association are effectively non-existent; LGBTQ+ organizations are impossible

The DPRK is a totalitarian state where every aspect of life is monitored. Any deviation from prescribed norms โ€” including any aspect of LGBTQ+ identity โ€” risks imprisonment in political prison camps. There is no safe arrangement, no legal protection, and no exit pathway from within North Korea. If you are currently in North Korea and are LGBTQ+, your best resource upon any opportunity to reach the outside world is UNHCR or a border crossing into China, followed by contact with South Korean or third-country authorities.
